Terms of Business

To avoid any misunderstanding or disappointment, please read these terms of business carefully before making a booking with Chocolate Juju Limited.

General Terms

Your use and purchase of products or services from Chocolate Juju Limited (referred to hereafter as CJL) is governed by the terms and conditions laid out below. Throughout these terms and conditions the term hirer refers to the person placing the order with CJL and is the person that CJL has a contract with.

Prices and Payment

The prices for the chocolate fountain service displayed on this website are as a guide only. A firm quotation shall be prepared and sent out to to the hirer along with a booking form. Prices in formal quotations are CJL's prices and are inclusive of VAT, labour, ingredients and delivery. Prices are valid and effective only in the United Kingdom.

All bookings attract a non-refundable deposit of 10% of the full price of the quoted service. CJL cannot accept an order until the deposit has been received (and in the case of cheques or postal orders, funds have cleared), unless otherwise agreed.

Upon payment of the deposit, CJL will confirm acceptance of the order by email or mail, whichever is the preferred method of contact indicated on the booking form. This confirmation will be sent to the appropriate address provided by the hirer on the booking form. Whether or not the hirer receives the mail or email of CJL's acceptance of the order, a completed and signed booking form will create a legally binding contract between CJL and the hirer. CJL reserves the right to refuse to accept an order at it's discretion. All goods, whether delivered or not, remain the property of CJL until paid for in full.

Payment is accepted in the following forms: Cheque, payable to "Chocolate Juju Ltd", Postal Order, major credit or debit cards - please contact us for details.

Payment of the balance is due 30 days prior to the required date of hire. Where there is less than four weeks between booking and date of hire then the full balance is due at the time of booking.

Cancellation and Refunds

You may cancel your order within 14 days of making your booking and provided that there is greater than four weeks to the date of hire you will receive full refund of any monies paid.

If you cancel after 14 days your deposit will not be refunded. Cancellations made within four weeks of the date of hire will attract the following penalties:
30 days - 3 weeks prior to event 25%
2 - 3 weeks prior to event 50%
Within 2 weeks of event 75%

Hirer's Responsibilities

It is the responsibility of the hirer to ensure that a sturdy table of no less that 4ft diameter or square is available at the venue to support the chocolate fountain.

It is the responsibility of the hirer to ensure that a the table is situated within close proximity of a mains power point and that it works. (CJL will bring an extension lead but for health and safety reasons it is preferable that the fountain is set up in a position such to reduce the risk of a trip hazard).

Disclaimer

CJL shall not be liable to you where performance of any of our obligations to you is prevented, frustrated or impeded by reasons by act of God, war and other hostilities, civil commotion, accident, strikes, lock outs, trade disputes, acts or restraints of Government imposition or restrictions of imports or exports or any other cause not within reasonable control of CJL.

If any part of these terms and conditions is found to be unenforceable as a matter of law all other parts of these terms and conditions shall not be affected and shall remain in force. To the extent permitted by law CJL accept no liability for any loss damage or injury arising as a consequence of the advice provided. These terms and conditions and any contact between us shall be governed by and constructed in accordance with English law and the English courts shall have jurisdiction over any dispute between us.

The Service Provided

The service provided to the hirer in accordance with this contract is described in the CJL literature and on the Chocolate Juju website. CJL reserves the right to change the dipping ingredients or chocolate provided at any point in time due to circumstances beyond the control of CJL.

CJL reserves the right to cancel the contract at any point in time should any problems relating to the supply of the goods or services be foreseen. CJL will always endeavor to contact the hirer at the earliest point in time should there be any need to cancel the contract or amend any contents therein.

Liabilities and Replacement or Removal of Service

Any theft or damage caused to CJL's equipment at the location of the booking will be liable to the hirer.

Under extreme circumstances, CJL may find it necessary to employ a third party to supply the service, this being the case CJL retains its rights herein.

CJL reserves the right to withdraw the service at any time during an event as a result of disorderly or criminal behaviour of any third parties that CJL feels may pose a risk to other third parties and its staff.

Copyright and Intellectual Property

The trade marks, logos, photographs, videos, images, data and other intellectual property used in connection with the Chocolate Juju Limited website are the property of Chocolate Juju Limited. None of the text and images from this website may be reproduced in whole or part without written permission from Chocolate Juju Limited.

No licence of any such intellectual property rights is granted to you as a result of your use of the Chocolate Juju website. Unless otherwise specified, the authors of the literary and artistic works in the pages in this Website have asserted their moral right pursuant to Section 77 of the Copyright Designs and Patents Act 1988 to be identified as the author of those works.
